FLAT® Table Bases Warranty

Please find our updated warranty below. There is no longer a need for you to register your product online. Your warranty will be valid from the date shown on your invoice.

In the unlikely event that you experience difficulties with your FLAT product, please contact the distributor or the retailer from whom you purchased the product to discuss your issue or any warranty claim.

Warranty Conditions: 1. The FLAT® product, consisting of the FLAT® levelling device, base, post, rod and top plate only, is warranted for 12 (twelve) months from date of purchase (unless specified elsewhere under special dealer extended terms, see dealer documents), subject to the terms and conditions contained herein. 2. The product will be repaired or replaced by FLAT® or FLAT®'s authorised distributors, if at their sole discretion it is found to be faulty within the terms of this warranty and within the warranty period. (Inspection and handling charges may apply if your product is not covered by our warranty terms and conditions) 3. Repaired or replaced parts, or products, will be warranted for the remainder of the original warranty period or for 90 days from the date of repair, whichever is the longer. 4. This warranty only applies to products sold and distributed internationally by FLAT® and its authorised distributors and/or retail outlets. 5. This warranty only applies if the product has been used in accordance with the manufacturer’s instructions under normal use and with reasonable care (in the opinion of FLAT® or FLAT®'s Authorised Distributors) subject to all terms and conditions set out in this document. 6. What this limited warranty does not cover: (a) Defects or damages resulting from the misuse of this product. (b) Defects or damages from abnormal use, abnormal conditions, improper storage, exposure to moisture, oils and solvents, extreme environmental changes such as temperature and humidity, dampness or corrosive environments, unauthorised modifications, unauthorised repair, neglect, rough handling, abuse, accident, alteration, acts of War, acts of God. (c) Breakage or damage to external parts; unless caused directly by defects in materials or workmanship. (d) The cost of delivery or transportation of the product to the distributor. (e) Normal wear and tear. (f) If the Product has been opened, modified or repaired by anyone other than an authorised FLAT representative, or if it is repaired using unauthorised spare parts. 7. FLAT® reserves the right to repair or replace your product with a new or re-furbished equivalent device. All parts or faulty product that have been replaced or exchanged become the property of FLAT .

LIMITED WARRANTY TO THE EXTENT PERMITTED BY APPLICABLE LAW: THIS LIMITED WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEDY AGAINST FLAT® AND FLAT 'S SOLE AND EXCLUSIVE LIABILITY IN RESPECT OF DEFECTS IN THE PRODUCT. FLAT® EQUALIZERS Warranty Policy

In the unlikely event that you experience difficulties with your FLAT Equalizers (FLAT® EQ) product, please contact the distributor or the retailer from whom you purchased the product to discuss your issue or any warranty claim.

Warranty Conditions: 1. The FLAT® product, consisting of the FLAT® Equalizers only, is warranted for 24 (twenty four) months from date of purchase (unless specified elsewhere under special dealer extended terms, see dealer documents), subject to the terms and conditions contained herein. 2. The product will be repaired or replaced by FLAT® or FLAT®'s authorised distributors, if at their sole discretion it is found to be faulty within the terms of this warranty and within the warranty period. (Inspection and handling charges may apply if your product is not covered by our warranty terms and conditions) 3. This warranty specifically applies to FLAT® Equalizers product subject to all terms and conditions set out in this document and expressly does not apply to any Non-FLAT manufactured table base or similar product to which the FLAT® Equalizers may be fitted. Installation of the FLAT® Equalizers product is made solely at the customer’s discretion and the customer acknowledges that FLAT cannot be held responsible for any incidental or consequential damages resulting from the installation of this product to old and/or damaged Non-FLAT manufactured table bases or similar products.

General Conditions of Sale Policy

1. Subject

1.1. These general terms and conditions of sale shall apply to the purchase of “FLAT” branded products (hereafter the “Products”) via the www.FlatTech.com website (hereafter the “Site”) by users.

1.2. The Parties involved in the purchase of Products via the Site shall be FLAT TECH INC. as Seller (hereafter the 'Seller ') and the party purchasing one or more Products, as the Buyer (hereafter the 'Customer') (the Seller and the Customer shall be referred to jointly as the 'Parties').

1.3. The Seller holds all rights to the Site's domain name, the logos, the registered trademarks relating to the products available on the Site and holder of all copyrights relating to the Site and its contents.

1.4. Any communication by the Customer in connection with and/or in relation to the purchase of the Products, including any notifications, claims or requests concerning the purchase and/or delivery of the Products or exercising the right to cancel, etc., shall be sent to the Seller at the addresses set out on the Site and in accordance with the procedure also set out on the Site and to the e-mail address [email protected].

1.5. All purchases are regulated by the general terms and condition of sale published on the Site at the time the order is submitted by the Customer.

1.6. On submitting the order, the Customer agrees that the confirmation of the order information and these general terms and conditions of sale shall be sent by e-mail to the address provided by the same during the site registration or purchase process.

1.7. Customers must be aged 18 or over in order to make purchases on the Site and have legal capacity; the Customer declares compliance with such requirements.

2. Product features and availability.

2.1. The products are sold by the Seller with the features described on the Site and in accordance with the general terms and conditions of sale published on the Site at the time of the order, excluding all other terms or conditions.

2.2. The Supplier reserves the right to amend all or part of these general terms and conditions of sale at any moment in time and at its own discretion, with no obligation to give notice to users of the Site. Any amendments shall come into force from the date on which they are published on the Site, and will only apply to sales concluded from that date onwards.

2.3. Sales prices, the Products sold on the Site and/or the characteristics of the same, are subject to change without notice. The Customer is therefore advised to check the actual prices before submitting the purchase order, pursuant to article 3 below.

3. Product purchase procedure - Conclusion of each individual purchase contract

3.1. The presentation of the Products on the Site, which are not binding for the Seller, is merely an invitation to the Customer to make a contractual offer to purchase and is not an offer to the public.

3.2. The purchase order submitted by the Customer to the Seller via the Site shall be a valid contractual offer and is subject to these General Terms and Conditions of Sale, which form an integral part of said order; by placing an order with the Seller the Customer undertakes to fully accept the same without reservation. Before proceeding with the purchase of the Products by sending the purchase order, Customers will be asked to read these general terms and conditions of sale carefully, further to the notice concerning withdrawal rights, to print off a copy of the same by clicking on the ‘print’ button and to save or keep a copy of the same for their own records. Customers will also be asked to check and correct any errors in their personal data.

3.3. The Customer's purchase order is accepted by the Seller by sending an e-mail to the Customer confirming the order, to the address provided to the Seller during the Site registration process, or during the order process if the Customer has not registered on the Site; the e-mail will include the text of these general sales conditions, a summary of the order placed and a description of the product features. The Customer’s order, the Seller's order confirmation and the general terms and conditions of sale applicable to the contract signed between the Parties will be filed electronically by the Seller’s IT systems and the Customer may request a copy of the same by sending an e-mail to the Seller at [email protected].

3.4. Any contract for the purchase of the Products shall be deemed concluded when the Customer receives the order confirmation from the Seller by e-mail

4. Product selection and purchasing procedure

4.1. The Products displayed on the Site can only be purchased by selecting the relative Products and adding them to your shopping cart. Once that selection is complete, in order to purchase the Products chosen and added to the shopping cart, the Customer will be asked to:

(i) register with the Site, providing details as requested, or,

(ii) where already registered, to login, or

(iii) to provide their details so that the order can be completed and the contract can be concluded.

If the details on the order are different from those provided during the Site registration phase, the Customer will be asked to confirm the details (by way of example and not limited to: name, surname etc.) as well as the delivery address for the Products chosen, the billing address and, on an optional basis, a telephone number on which the Customer can be contacted in relation to the purchase made. The Customer will be shown a summary of the order to be processed, and any change in the contents: at this point, the Customer, is required to carefully read and expressly approve the general terms and conditions of sale by ticking the relative check box and, finally, confirm the order by pressing the 'Place Order' button; this will send the order to the Seller with the consequences illustrated in paragraph. 3.2. of this contract. The Customer will also be asked to select a delivery option and a payment method from those available. If the Customer selects immediate payment by credit card or Pay Pal, he/she will be prompted to provide the relevant data via a secure socket connection. The Seller reserves the right to check the personal details provided by the Customer for accounting and administration purposes. For payments by credit card, the purchase price will only be charged to the Customer when the Seller sends the actual order confirmation.

4.2. If the Customer has completed the purchase order which includes a Product whose price is clearly lower than the standard applicable price, net of any discounts and/or promotions in force at that time, due to a technical problem that has occurred on the Site and if the Customer has not yet received the Product, the Seller shall:

(i) cancel the order, block the delivery and send notice to this effect by e-mail to the address provided by the Customer during the order transmission phase and

(ii) refund the Customer with the payments effected pursuant to the cancelled order, including shipping costs, without delay and, in any case, no later than 14 days from cancellation of the order, using the same payment method used by the Customer for the initial payment.

5. Delivery and acceptance of goods

5.1. Whilst the Site generally states whether or not Products are available and the relevant delivery times, such information is purely indicative and under no circumstances binding on the Seller.

5.2 The Seller undertakes to do everything within its power to comply with the delivery times given on the Site and, in any event, to deliver within a reasonable period after the Customer places the order. If the order cannot be processed by the Seller, as the Product ordered by the Customer is not available, even temporarily, for delivery, the Seller shall contact the Customer and refund the amount already paid as illustrated in more detail in art. 5.3 below.

5.3. The Products ordered by the Customer shall be delivered according to the method chosen from those available and listed on the Site when the order was placed. The Customer undertakes to promptly check, within and no later than 3 (three) days of receipt of the Products, that the delivery is correct and includes all and only the purchased Products, and to notify the Seller, within this deadline, of any faulty products received or any discrepancy between the order and the goods actually received, following the procedure referred to in art. 8 of this contract; failure to do so will infer that the Products shall be deemed as accepted. In the event that the packaging or boxing of the Products ordered by the Customer reaches its destination visibly damaged, the Customer ” agrees to notify the Seller within and no later than 3 (three) days of receipt of the Products.

6. Prices, shipping costs, customs duties and taxes

6.1. The price of the Products on sale is that indicated on the Site at the time the order is placed by the Customer. Product prices shown on the site are inclusive of the costs of standard packaging.  Freight prices and Sales Taxes (if applicable) are shown separately on the site provided shipping options have been selected and must be added to the Product prices.

6.2. The total price payable to the Seller will be indicated in the Order inclusive of Freight prices and Sales Tax (if applicable) and will also be indicated on the order confirmation sent via e-mail by the Seller to the Customer.

6.3. The Products are to be delivered only to the United States of America. The total price stated in the order and order confirmation excludes any customs duties and any other related taxes.

7. Payments

7.1. Payment for Products purchased on the Site shall be made when the order confirmation is sent by the Seller to the Customer. The Customer expressly agrees that performance of the contract by the Seller will commence the moment when the order confirmation is sent by the Seller to the Customer.

7.2. Payments for orders placed on the Site can be paid for by credit card, or via PayPal at the conditions provided below.

7.3. When payment is by credit card, the Customer will be transferred to a secure site and the credit card information will be communicated directly to the operator designated by the Seller to handle all such transactions. The data provided will be sent securely using SSL (Secure Socket Layer) encrypted file transfer systems. Such data remains inaccessible to the Seller.

7.4. The Invoice relating to the purchase will be sent to the Customer in electronic format, to the e-mail address provided by the Purchaser during the registration process.

7.5. Should the Seller be required to refund the Customer for the price paid, the refund will be effected, where possible, using the same payment method used by the Customer to purchase the product, or by bank transfer. The Purchaser will be responsible for sending the Seller, using the same e-mail address [email protected] the bank details for the latter to be able to transfer the refund.

8. Intellectual Property Rights

8.1. The Customer acknowledges that he or she is aware that all trademarks, names and other distinctive signs as well as any names, images, photographs, written text or graphics used on the Site or relating to the Products are and remain the exclusive property of FLAT TECH INC. and Related Entities and/or its assignees, with no rights arising on the part of the Customer in relation to the same as a result of access to the Site and/or purchase of the Products.

8.2. Unless prior specific consent is granted in writing by FLAT TECH INC. or a Related Entity, no contents of the Site can be reproduced in whole or in part, transferred using electronic or conventional means, modified or used for any purpose whatsoever.

9. Protection of Customer Personal Data

9.1. In order to proceed with the registration process, place an order and sign the contract, the Customer is required to provide certain personal details. The Customer hereby acknowledges that the personal data provided will be recorded and used by the Seller to process each purchase via the Site and, upon granting his consent, for any other activities as illustrated in the specific Informative Note on the Personal Data Protection Code provided to the Customer by the Site during the registration phase.

9.2. The Customer hereby declares and guarantees that the personal details provided to the Seller during the registration and purchase process are truthful and accurate.

9.3. The Customer is entitled, at any moment in time, to update and/or amend the personal data submitted to the Seller via the “Account Login” section of the Site.

9.4. For any further information on how the personal details of Customers are processed, please refer to the Privacy Policy and read the General Conditions of Use carefully.

10. Security

10.1. While the Seller takes all necessary precautions to protect personal data from being leaked, falsified, manipulated or used by unlawful third parties, due to the characteristics and technical limitations concerning the protection of electronic communications via the Internet, the Seller does not guarantee that the information or data viewed by the Customer on the Site, even after the Customer has provided relative login credentials, will not be accessible or viewable by unauthorised third parties.

10.2. Where data in relation to payments made by credit card are concerned, the Seller uses services which adopt technological systems to guarantee maximum levels of reliability, security, protection and confidentiality for information transmitted over the web.

11. Applicable law, settlements and jurisdiction

11.1. Any sales contracts signed between the Seller and the Customer under these general sales conditions shall be governed and construed in accordance with the Laws of Illinois USA.

FLAT Orders Policy

Online Security

To ensure our customers’ safety online, all orders go through security checks before we start processing them. Please keep this in mind while ordering, as there may be a slight delay before processing for a small percentage of orders. If additional information is needed to help ensure the order’s validity, we will communicate via email or telephone.

Price Increases

All items on our website have pricing which may be subject to change. For pending alternate payment orders, we reserve the right to enforce these price increases on orders not paid in full by the specified deadline. In order to ensure that you receive the most accurate pricing on your order, please pay in full prior to the effective date of the increase.

Primary Form of Communication

In order to provide our customers with the most up to date information regarding products and orders, our primary form of communication is via email. All order updates will be sent to the email address used when the order was placed. For this reason, please be sure to use a valid email address when placing your order. If you have questions that need to be directed to our team, you are welcome to contact us via email.

Site Errors – Pricing

All prices are subject to change without notice. In the rare event that a product is listed at an incorrect price due to a website error, Flat will resolve the discrepancy, at our discretion, on all orders placed for the product listed at the incorrect price. This resolution may involve coming to an agreed-upon price with the customer or a cancellation of the order, resulting in a full refund.

Stock Availability

Occasionally, we may temporarily run out of a stocked item due to high demand. Should this occur, we will send you an out-of-stock e-mail within one full working day. You may also contact us to check stock on the items you’re purchasing prior to placing your order.

Cancelling/Modifying an Order

Please contact us immediately should you wish to cancel or modify an order!  An order may be cancelled or modified at no additional charge only prior to the order having been processed by our manufacturers or by our warehouse. If an order has already been processed by our manufacturers or by our warehouse, has been shipped and/or has been received by the Buyer, the order may not be cancelled. Any additional charges incurred as a result of order changes or cancellations, including but not limited to labour costs, costs of material and extra freight charges, are the responsibility of the Buyer.

If we cannot cancel an order that you no longer want or want to modify, please refer to our Returns Policy.

Change of Shipping Address

Please contact us immediately if you would like to ship your order to a different address than you indicated at checkout. Once an order ships, there are fees associated with changing the shipping address that would need to be collected before the change can take effect. The cost of changing the shipping address will depend on the shipping method and number of shipments. If an order has already left our warehouse before the shipping address change is made, we cannot guarantee that it will arrive at the new location. If a carrier tries to deliver a shipment several times and is unsuccessful, your order will be returned to us and treated as a standard return.

RETURNS AND REFUNDS POLICY

We are unable to accept returns or exchanges of product unless it was purchased through www.flattech.com

FLAT will fully refund or replace any goods purchased if they are found to be faulty or damaged.

Change of Mind or Incorrect Size

If you change your mind about the products you have ordered or have ordered the incorrect size, your product(s) purchased can be returned to us for a refund or exchange under the following conditions:

  • Products must be in the original, saleable condition and packaging.
  • Products must be sent back within 10 days from original receipt of goods, and your proof of purchase / order information must also be included in the return.
  • Return freight back to FLAT Tech Inc. is the responsibility of the customer and there is a restocking fee on all returns; 20% for commercial customers and 30% for residential customers. 

Failure to meet with these conditions will result in an exchange or refund being denied.

Refunds will be processed in the same form that you originally paid for your order as soon as possible upon receipt of the returned products. 

Please note that refunds cannot be processed to expired credit cards.

The total value of the refund will equal the payment made for the goods purchased, excluding freight and any other relevant fees, if any. 

No refunds or replacements will be given if the carton has been opened and the product has been damaged or tampered with.

Faulty or Defective Product

If you believe the product is faulty/defective in any way, you may request an exchange of the product concerned under the terms of our Warranty.

In order to arrange the return of a faulty or defective product, please contact our Team by emailing [email protected] including your name, telephone number, invoice number and name of product, along with the reason you believe the product is faulty.

Upon receipt of your email, we will email you a return authorisation number and inform you where to send the faulty product.

FLAT will exchange a faulty/defective product if it is found there was a production error. If it is found that the product is faulty, the product will be replaced (the same size and value of the original product ordered) and the exchange shipping will be paid for by FLAT.

If it is found that the product is NOT faulty, the customer will be charged the shipping fees. 

Order Cancellations and Changes

FLAT will endeavour to arrange the dispatch of your order as soon as we receive it. If you have changed your mind about your order and would like to cancel or change it, please email [email protected] as soon as possible, quoting your FLAT order number.  If your order has already entered the dispatch process, unfortunately, it cannot be changed or cancelled.

Incorrect Orders

If you have received your order from FLAT and it is incorrect, please email [email protected] and include your FLAT order number, so that we can arrange to have the correct products sent to you and the incorrect products returned to us.

We will dispatch the correct replacement for any incorrect product within 2 working days of receipt of return of the incorrect products subject to sufficient stock on hand.  Your return must be accompanied with a proof of purchase and the products must be returned in a new, unused and re-saleable condition.

We request customers advise us as soon as possible if their order has been delivered significantly late, damaged or incorrect. If this is the case, please email us at [email protected].

Please note that all claims will be honoured at the discretion of FLAT and we reserve the right to refuse to refund or replace any customer claims when returns are excessive and/or it appears that potentially the policy is being manipulated or abused.

Shipping Policy

Delivery

Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by you, or as close as possible to the date required. We request that you make all arrangements necessary to take delivery of the order whenever it is tendered for delivery. Any damages, shortages, over deliveries and duplicated orders should be reported to FLAT within 7 days of receipt of Goods to enable replacement, refund or reprocessing. 

Shipment Damage/Error

Inspect your shipment thoroughly upon delivery and report any damage or errors within 7 days of receipt of package. Replacements for damaged merchandise are at the sole discretion of FLAT and must be reported within 7 days in order to receive replacements. The customer must retain the original packaging in order to receive replacement parts. Photographs of the damaged goods and their original packaging may be requested in order to receive any replacements. Damage caused after receipt of goods by the Customer or Customer’s representative is not covered under any warranty or agreement, and FLAT shall not be responsible for any damage that goods may incur after they have been received by the Customer or Customer’s representative.

Please ensure to provide a valid telephone number and email address during checkout so that your call before delivery does not delay your shipment.

Risk

Risk in the Goods shall pass to the Customer upon dispatch of the goods. Where the Customer chooses to collect the Goods itself, risk will pass when the Goods are entrusted to it or set aside for its collection, whichever happens first.

Title

Title in the Goods shall pass to the Customer upon receipt of full payment for the goods by FLAT.

Shipping Charges

FLAT generally does not provide for free shipping of any Goods to any location and has sole discretion to select methods of shipment and shipments dates. Should the Customer wish to procure their own means of shipment, the Customer can collect goods at the shipment’s origin location in Davenport, Iowa at the expense of the Customer, whether by the Customer or through the Customer's approved third party.

Refuse Shipment

If Customer choses to refuse shipment of Goods, they may do so. Once Goods have been refused, they are considered Returns and are subject to Flats Returns Policy as noted on this website. No freight charges will be refunded, and the Customer holds sole responsibility for all associated freight charges associated with the Customer’s order.

Force Majeure

Should FLAT be prevented from effecting deliveries of the Goods or any of them by reason of either an act of God/s or nature, insurrection, riot, war hostilities, terror attacks, warlike operations, piracy, arrests, restraints or detainments by any competent authority, strikes or combinations or lock out of workmen, fire, floods, droughts, earthquakes, permanent or temporary delay or inability to obtain labour, material or services through FLAT's usual and regular sources, or any other circumstances (whether of a nature similar to those specified, or not) beyond the absolute control of the FLAT, then, in each such cases, the obligation of FLAT to effect deliveries hereunder shall be suspended until after such prevention shall cease to continue.

Should any deliveries under this Contract be suspended under this clause for more than 90 days, either party may withdraw from this Contract and be relieved from any liability; provided however, that the Customer shall nevertheless accept delivery and pay for such Goods once FLAT is able to deliver in accordance with the period(s) of shipment named in this Contact.

FLAT shall not be held liable for, and be relieved from, any loss or damages of any kind resulting from the causes mentioned herein above.
